Introduction

  1. These Terms and Conditions govern all services provided by Nillumbik Community Health Service Ltd t/a as heathAbility (healthAbility, we, us, or our).

  2. Please read these Terms and Conditions carefully before booking. By purchasing or using our services, you agree to be bound by these Terms and Conditions.

  3. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions will apply to new services booked or purchased.


Booking and payment

  1. We accept payment by credit card or other payment methods specified on our website.

  2. You must pay for all services at the time of booking.

  3. You must provide accurate and complete information (including in relation to any pre-existing medical conditions and injuries) when booking our services.

  4. We reserve the right to cancel or reschedule your service booking if payment is not received.


Access and security

  1. A booking of any service which is delivered at your property is subject to you completing a home risk assessment to our satisfaction which we will undertake over the phone in order to confirm your booking.

  2. On the day of service, you must provide us with access to the property where the services will be performed. You are responsible for ensuring the security and safety of your property during the services.


Cancellation and rescheduling

  1. Subject to clause 11 and 12, you may cancel or reschedule your service booking prior to the scheduled time without incurring any cancellation fees.

  2. If you cancel or reschedule your occupational therapy service appointment, you will be charged a cancellation fee of:
    1. 20% of the full service fee if cancelled on less than 48 hours’ notice; or

    2. 100% of the full service fee if cancelled on less than 24 hours’ notice.

  3. If you cancel or reschedule any service booking booked under a government subsidised home care plan on less than 48 hours’ notice, you will be charged the full service fee.

  4. We reserve the right to cancel or reschedule your service booking due to unforeseen circumstances, such as inclement weather, or equipment failure. In the event of cancellation, we will refund the amount you have paid. In the event of rescheduling, we will reschedule to a time agreed by you.


Travel

  1. Travel time has been included in the service package for metropolitan Melbourne clients within a 30 minute distance from our premises each way.

  2. Where travel exceeds the 30 minute limit, our charge rate is $82 plus GST per hour. We will notify you if this travel fee applies. The fee will be deducted from the balance of your Gifts with Heart gift card (if applicable) or charged to you post-delivery of the service.

  3. We are unable to travel to regional Melbourne for the purposes of delivering the services. For a full list of our serviceable areas, [insert link].


Liability

  1. We are not liable for any damage or loss arising from, or in connection with:
    1. your failure to provide access to, or ensure security and safety at, your property;

    2. your failure to adequately disclose any pre-existing medical conditions or injuries; or

    3. your acts or omissions.

Governing Law
