1. If you use, engage with or attend any of the follow activities, you consent to these terms and conditions:
- events, class or other sessions either hosted by Nillumbik Community Health Service Ltd ABN 32 180 310 839 trading as healthAbility (“us” or “we”), or our representatives, on our premises or elsewhere;
- engage with, participate in or subscribe to any of the services we offer;
- attend any of our premises either as a client or otherwise; and
- events or activities hosted by other parties where healthAbility is participating
(collectively referred to as Activities)
2. Unless you inform any of our employees or representatives prior to the Activities that you do not consent to these terms and conditions, your consent is deemed to have been given for the purposes of these terms and conditions.
Image Consent
3. You acknowledge that we, or any third parties authorised by us, may make or record film, photographs or other forms of moving picture, still picture or any of the Activities (including, without limitation, of persons attending or participating in the Activities). You hereby grant us, and any third parties authorised by us, permission to publish photographs, film, tape or other images or likenesses of you, including audio of your voice (Your Image), in any media and for any purpose (including promotional purposes) without compensation or payment of any kind.
4. To the full extent permitted by law, You release us from any and all claims, loss damage, costs of expenses (including consequential loss) or otherwise arising out of or in connection with a publication incorporating Your Image. This indemnity expressly includes (without limitation) any claims for defamation, breach of privacy, or copyright.
