Introduction

  1. These Terms and Conditions govern the purchase and use of a Gift with Heart gift card provided by Nillumbik Community Health Service Ltd t/a as heathAbility (healthAbility, we, us, or our).

  2. Please read these Terms and Conditions carefully before purchasing or using the gift card. By purchasing or using the gift card, you agree to be bound by these Terms and Conditions.

  3. We reserve the right to change these Terms and Conditions at any time. Any changes to the Terms and Conditions will apply to new gift cards purchased.


How and where you can use the gift card

  1. The gift card can only be used for purchasing healthAbility services listed here. Services require bookings and are subject to availability.

  3. The gift card is not redeemable for cash or other form of compensation, is non-refundable, and cannot be transferred or cancelled.


Validity and gift card expiry

  1. The gift card expires 3 years after date of purchase. Any remaining balance is forfeited upon expiry.


Fees and charges

  1. If the service fee exceeds the balance available on the gift card, you are responsible for paying the difference at the time of booking.


Customer’s responsibilities 

  1. Any attempt to use the gift card fraudulently may result in cancellation.

  2. We reserve the right to cancel a gift card if misuse or fraud is reasonably suspected. 

  3. Lost, stolen or damaged gift cards will not be replaced, to the extent permitted by law.


Data and privacy

  1. We use third-party providers including Square, Jotform and Mailchimp to process your purchase and deliver confirmation emails. By proceeding with your purchase, you consent to your name and email being disclosed to Mailchimp (based in the USA) for the purpose of delivering your digital gift card confirmation and administering your use of the gift card.

Governing Law
